Welcome to ID Travel Group. These terms and conditions set forth below outline the rules and regulations for the use of this website www.idtravelgroup.com. By accessing this website, you accept these terms and conditions. Do not continue to use the ID website if you do not agree to all the terms and conditions stated herein. All reservations and/or purchases you make through us are subject to the terms, conditions and notices as they exist at the time the reservation is made and as are currently set forth below. We reserve the right to change these terms, conditions and notices, and you agree to accept and be bound by such terms, conditions, and notices stated here.
You confirm that you are at least 18 years old and possess the legal authority to enter into an agreement with ID and to use this website in accordance with the terms and conditions outlined herein. You also agree that all information supplied by you while using this website is true and accurate.
Personal information that you provide when using our website and booking trips will be treated in accordance with our Privacy Policy on our website.
ID TRAVEL GROUP LLC – TERMS AND CONDITIONS
This agreement contains the terms and conditions by which ID Travel Group LLC (also doing business among others as “Island Destinations”, “ID×” and “ID Ultimate Itineraries”), 1875 Palmer Avenue, Larchmont, NY 10538, USA (“ID”) in consideration for a payment agrees to organize the arrangements for one or more travelers (the “Participant”, used herein to signify singular and plural connotations) outlined in the itinerary sent to the Participant or as amended by mutual agreement (the “Trip”). Please read this agreement carefully. By accepting ID’s services under this agreement, Participant agrees to the terms and conditions herein for and on behalf of all travelers on the Trip.
RESPONSIBILITY AND LIABILITY: ID, as the principal, is responsible for making arrangements for the services and accommodations offered in connection with the Trip. ID does not own or operate any of the firms or entities which will provide goods and services for the Trip or for any option which may be available in connection with the Trip including package items and optional side trips, such as but not limited to transfers whether by land or water, car rentals, excursions (including land and boat options) and any other items detailed in the itinerary (the “Suppliers”). Participant understands that this may include Suppliers that, for marketing purposes, may use branding as “an ID Travel Group Company” or similar that is intended solely to identify an independent Supplier, unaffiliated to ID, that provides services to ID clients. ID accepts no responsibility for any failings by any Supplier whether so branded or otherwise. ID has not priced the Trip or options to allow ID to guarantee against any failures of any Suppliers. Participant is advised that most trips organized by ID involve travel outside the home country of the Participant and that laws, regulations and legal requirements in other countries regarding matters of safety, hygiene and disclosure for hotels, car hire, air transportation, yachts, taxis and other providers of goods and services in trips may be of different or lower standards than in the Participant’s home country. If Participant has any concerns about any aspects of a Supplier, ID recommends that Participant undertakes direct checks of the Supplier and if requested ID will supply information to assist in any such check. Participant agrees that in the event of any disputes or problems with Suppliers, the Participant will seek remedy legal or otherwise only directly with the Suppliers in accordance with local laws and practice and will not attempt to enforce standards or laws of the Participant’s home country and will not hold ID responsible for any loss, injury, delay or expense which results directly or indirectly from any action or omission, whether negligent or otherwise, of any Supplier providing goods or services for the Trip or available option (such as but not limited to injuries or death, the quality of services, cleanliness of a hotel, hotel overbooking, any flight delay or change of schedule). Participant also agree not to hold ID liable for circumstances beyond its control (e.g. force majeure).
The Participant acknowledges that neither ID or its agents have made any other representations or promises with respect to the Trip unless expressly set forth in writing and signed by an officer of ID and that this represents the only agreement between Participant and ID. Any other printed or verbal statement of terms and conditions is for information only and is superceded by this agreement. At any time, ID may decline, for any reason, any person as a Participant on a Trip (or option) whereupon ID’s only obligation shall be to refund to the Participant that portion of payment allocated to the unused services. ID may cancel any Trip at any time for any reason in which case ID’s liability is limited to a full refund within 60 days. ID shall not be liable for any cancellation of services by a Supplier whether before or after commencement of the Trip and the Participant acknowledges that once payment has become due to a Supplier by ID, any refund will be with the agreement and at the discretion of the Supplier.
PAYMENT: All payments due to ID must be made in U.S. dollars by checks drawn on banks located in the United States, or by wire transfer to an ID bank account or by duly authorized charges on major credit cards accepted by ID. If payments are not received at the office of ID by the due dates, reservations may be canceled without further notice and cancellation penalties may apply. Payment by credit card is subject to the terms and conditions outlined on the payment form supplied by ID. The release to ID electronically, or by fax, telephone or other means by the Participant or his agent of a credit card number, name as on the card and date of expiration of the card shall, with the use thereof by ID for the purpose of charging a Trip, be deemed as authorization for payment of Trip by credit card. In the event of any dispute, Participant agrees that requests for refunds will be made under the procedure described below under Cancellation and Refund Policy and Participant agrees not to dispute the charge and to waive any charge back provisions. Any payments due directly to Suppliers are subject to their payment terms and conditions. Please note that many hotels do not accept personal checks for charges payable on or after arrival. Any check received by ID that is returned by a bank for any reason will incur a $50 additional charge.
CANCELLATION AND REFUND POLICY: Participant’s right to a refund varies according to the type of trip booked. Generally, land arrangements are fully refundable less $75 administration fee if written notice of cancellation is received by ID 45 or more days before departure, but stricter cancellation policies may apply for certain dates or at certain properties, as notified in individual cases. For cancellation later than 45 days before departure, there is no refund, unless Participant has purchased ID’s Peace of Mind Protection plan, in which case any refund is in accordance with the terms of that plan. No refunds are permitted for short stays unless agreed in writing between the Participant and the Supplier in which case a $75 administration fee will be charged by ID if monies are processed through ID. Air packages and air tickets are subject to cancellation policies imposed by the airlines. In addition, ID levies a $50 per ticket administration fee for tickets returned for cancellation or changes requiring re-ticketing regardless of the circumstances. Please note that proof of medical or family emergency will not result in refunds for most international trips. In addition, many tickets distributed by ID are non-refundable and non-changeable once issued. To mitigate penalties, Participant(s) are strongly recommended to purchase the Peace of Mind Protection Plan, which is available from ID. There is no refund for package
departures not used through no fault of ID. Refunds involving overseas Suppliers, once agreed, can take six or more weeks to process, and ID is not responsible for any delays.
CHANGE POLICY: Any change to a confirmed reservation is subject to availability and any penalties or fees imposed by Suppliers. In addition, ID levies an administrative fee for each change requested by a Participant.
DOCUMENTS: Travel documents are generally mailed or delivered electronically by ID to Participant’s Travel Professional approximately 21 days before departure. Air tickets are issued electronically. Please check all names on documents upon receipt, as ID is not responsible for any errors or omissions unless reported within 24 hours of receipt. Participant should check directly with embassies or consulates of any foreign countries being visited with regard to documentation and visa requirements.
AIR TRAVEL: Airline reservations are made by ID based upon information supplied by the airlines and their representatives with regard to fares and schedules. Until ticketed, all fares are provisional and subject to change. Late changes in schedules are sometimes made by the airlines and some flights are unfortunately delayed, resulting in missed connections, shortened vacation time, inconvenience, hardship or additional expenses. These items are completely outside the control of ID and ID accepts no
liability for any such items. In the event of delay or schedule changes, the airline, not ID, will determine the procedure to be followed and the amenities or compensation, if any, to be offered. Participant is subject to the ticket terms and tariffs of the airline, which shall be the sole contract between the airline and the Participant. Participant is strongly advised to re-confirm departure times, etc. of all flights before departure and before returning home.
WATER TRANSFERS: Information on boat schedules is provided for the convenience of Participant but is not guaranteed by ID. Participant is advised to re-confirm all departure times directly with operators. ID is not responsible for delays, missed connections, etc.
GOVERNING LAW These terms and conditions and any disputes arising from them shall be governed by the laws of New York State. You and we agree to submit to the exclusive jurisdiction of the courts of New York regarding any such dispute.
CHAGES TO TERMS AND CONDITIONS The terms and conditions which apply to your trip are those which are featured on website the time of booking, and any other terms notified to you electronically before departure. We reserve the right to update these terms and conditions from time to time. Any such updates shall take effect immediately upon posting on our website.
